High Court Curtails Shopclues.com From Selling L’Oréal Paris Products

Shopclues.com has been restrained from Delhi High Court for selling fictitious products of L’Oréal , nearly four years after the French cosmetics giant filed a case against the e-commerce website.

The court has observed that the e-commerce websites and the online marketplaces must operate with caution in order to enjoy the immunity provided to intermediaries, said L’Oréal India in a statement.

The court also held that shopclues.com was disqualified for the exemption under Section 79 of the Information Technology Act, 2000 as the websites role was more than that of an intermediary,” added the statement.

Counterfeits is a serious issue faced by the beauty industry in India across online and offline platforms. This verdict will help us fortify our fight against online counterfeiting rampant on such marketplaces. We understand the importance of consumer protection and are hence encouraged by this first-of-its kind decision,” the Managing Director of L’Oréal India, Amit Jain said.

The court has directed the website for disclosing the complete details of all its sellers and their addresses,obtain certificates from sellers stating that the products are genuine and obtain the brand’s permission before uploading any of its products for sale on their platform.

From the past few years there has been several petition filed with the courts by the brands and the consumers on the fake products issue.

The e-commerce company has picked up speed and with tge consumers shedding apprehensions regarding the online purchase, foreign companies have seen a sugnificant increase in fakes being sold on different ecommerce sites.

Various companies those include Tommy Hilfiger, Lacoste, Calvin Klein, Levi’s and Superdry, over the past three years, have helped seize  thousands of fake apparels through the court-aided raids on the warehouses, those are either owned by the sellers or the smaller niche fashion portals.
